Lindsay Lohan may avoid jail time as prosecutors are working out a plea deal for the actress' June car crash case, despite a new report that she may have smelled of alcohol at the scene.
According to TMZ.com, police sources said that Lohan's breath allegedly "smelled of alcohol."
There were previous reports that a bottle of alcohol was also found at the scene. The cops did not perform a field sobriety test at the scene of the crash, the New York Post reported.
Amid the new claims, the Santa Monica City Attorney is said to be willing to offer the star a plea bargain which would include 60-days in a residential rehab facility.
According to the gossip site, the plea bargain also stipulates that the troubled star attend AA meetings and undertakes community service, although she might be able to complete the work in New York should she accept the deal.
The 'Liz and Dick' actress is charged with three misdemeanor charges of reckless driving, lying to police and obstructing officers from performing their duties. She insists she was not behind the wheel of the Porsche and has pleaded not guilty.
Lohan's lawyer Mark Heller has suggested to prosecutors that the actress serve as a motivational speaker and perform non-jail activities to resolve her latest criminal case, according to a letter to the court.
The letter proposes several alternatives for Lohan, who could be sent to jail for up to 245 days if a judge determines her actions in a traffic crash violated terms of her probation in a previous theft case.
His letter states that Lohan's turbulent home life has deeply impacted her and requires a different approach in the case.
The letter states that the actress plans to spend time recording public service announcements and make "periodic visits to schools, hospitals and other venues where she may provide inspirational talks, encouraging children to pursue positive goals and avoid bad habits." (ANI)
