Delhi rape: Bone test for accused minor

New Delhi: A bone-marrow test will be conducted on the youngest accused in the Delhi gang rape case to ascertain whether he is a minor, said reports.

Reports quoting sources said the prosecution will demand death for the five accused since the rape charges were later upgraded to murder with the death of the victim in Singapore.

According to law, the maximum punishment for rape is a life imprisonment and death for murder.

However, a minor cannot be prosecuted for murder. Such a person can only be produced before a juvenile justice board.



In this case, the accused, if proven a minor, could be sent to a children's home for a maximum of three years.

The six will be formally charged in court on Thursday on accusations that they kidnapped, gang raped and murdered the 23-year-old woman in New Delhi on Dec. 16, police spokesman Rajan Bhagat said on Tuesday.

Media reports say some 30 witnesses have been gathered. The police will submit its 1,000-page chargesheet at the magistrate's court in Saket on Thursday, following which it will be transferred to a fast-track court.

On December 16, the medical student, who was returning home after watching a movie with her boyfriend, was gang raped by six men on a bus and assaulted with an iron rod. She succumbed to her injuries on December 29 at a Singapore hospital.
