New Delhi, Apr 5 (IBNS) The National Investigation Agency (NIA) on Friday will present a First Information Report (FIR) against two Italian marines to a special Patiala House court in New Delhi on Friday.
The NIA on Thursday registered an FIR against Italian marines Massimiliano Latorre and Salvatore Girone in connection to the 2012 killing of two Kerala fishermen.
According to top NIA sources, the marines have been charged with murder under Section 302 of the Indian Penal Code (IPC).
"The marines have also been booked under Section 3 of Suppression of Unlawful Acts Against Safety of Maritime Navigation and Fixed Platforms on Continental Shelf Act (SUA) that entails death penalty for murder at sea. The other charges include Section 427 (mischief) and Section 34 (common intention) of the IPC," said an NIA official on condition on anonymity.
The Ministry of Home Affairs (MHA) handed over the case to the NIA on Monday.
The Kerala Police was probing the case.
The Supreme Court earlier said the Kerala had no jurisdiction to try Italian marines Massimiliano Latorre and Salvatore Girone.
The Supreme Court on Feb 22 had allowed the two Italian marines to travel to Italy to cast their votes in the country´s elections.
Italy later said they will not send them back to India for trial.
The two marines, however, returned to India on Mar 22, after Italy´s decision had sparked off a diplomatic row between the two countries.
On Feb 15, 2012, the security officials of Italian cargo vessel Enrica Lexie allegedly shot dead two Indian fishermen mistaking them as pirates in the high seas off Ambalapuzha in Kerala. They were subsequently arrested.
